Please read these Terms of Service ("Terms") carefully before using the Constellation Guide app ("the App") provided by Probability LLC ("we," "us," or "our"). By downloading or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Constellation Guide, you confirm that you are at least 4 years old (or have parental consent if applicable), have read and understood these Terms, and agree to be bound by them and our Privacy Policy.
2. License to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, subject to these Terms and the App Store Terms of Service. You may not copy, modify, distribute, sell, or reverse engineer any part of the App.
3. AI-Generated Content Disclaimer
The App includes an AI Sky Guide feature that uses large language model technology (OpenAI GPT-4o-mini) to answer astronomy questions and generate educational content. Please note:
- AI responses are provided for educational and entertainment purposes only.
- AI-generated content is not a substitute for professional astronomical advice or scientific research.
- Responses may occasionally be inaccurate, incomplete, or outdated. Always verify important information from authoritative sources.
- We are not responsible for decisions made based on AI-generated content.
4. Subscriptions
Constellation Guide may offer optional premium subscriptions ("Pro") with additional features. Subscription terms:
- Billing: Subscriptions are billed through your Apple ID account at confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- Cancellation: You may cancel at any time through your iOS Settings → [Your Name] → Subscriptions. Cancellation takes effect at the end of the current billing cycle; we do not provide refunds for unused subscription time.
- Price Changes: We may change subscription prices with advance notice. Continued use after a price change constitutes acceptance.
- Managed by Apple: All billing, payment processing, and refund requests are handled by Apple. We do not have access to your payment information.
- Refunds: Refund requests must be submitted directly to Apple at reportaproblem.apple.com.
5. Star Dedications (Future Feature)
Constellation Guide may in the future offer a "Star Dedication" feature allowing users to associate a name or message with a star in our in-app catalog. Important disclaimers:
- Star Dedications are entirely symbolic and for entertainment purposes only.
- They are not recognized by the International Astronomical Union (IAU), any government body, or any official astronomical registry.
- No official naming rights are conveyed. Official star names are governed by the IAU.
- Probability LLC makes no representations that your dedication will be recognized outside the App.
6. Content Guidelines
If you submit content through the App (such as dedication messages), you agree not to include:
- Offensive, hateful, or discriminatory language
- Content that is threatening, harassing, or abusive
- Sexually explicit material
- Content that violates any applicable law
- Personal information of others without their consent
We reserve the right to remove any content that violates these guidelines at our sole discretion.
7. Intellectual Property
All content, features, and functionality of the App — including but not limited to text, graphics, logos, star maps, astronomy articles, and software — are the exclusive property of Probability LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from App content without our prior written consent.
8. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Probability LLC and its officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising from your use of or inability to use the App. Our total liability to you for any claims arising from the App shall not exceed the amount you paid us in the 12 months preceding the claim, if any.
10. Governing Law
These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law provisions. Any disputes shall be resolved in the courts located in Wayne County, Michigan.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms at this URL with a revised effective date. Your continued use of the App after changes constitutes acceptance of the updated Terms.
12. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, all licenses granted to you will immediately cease.
